Fort Knox soldier has hearing in civilian killing

ELIZABETHTOWN, KY. — A U.S. Army soldier charged with murder in the shooting death of a Fort Knox civilian employee is scheduled to appear for a hearing this week on post.

Sgt. Marquinta Jacobs is accused of killing 51-year-old Lloyd Gilbert on April 3. According to investigators, the 36-year-old soldier approached Gibert in a parking lot near the building where Gibert worked. Witnesses said the two argued before Jacobs struck Gibert and then fired at him with a .45-caliber handgun.

Jacobs was arrested the following day in Portland, Tenn., where his mother lives.

Fort Knox spokesman Kyle Hodges told The News-Enterprise in an email that Jacobs will appear on post Wednesday for an Article 32 hearing. That is similar to a grand jury indictment in a civilian court, but the defendant is allowed to be present.

According to a release from the post, a commissioned officer is appointed to conduct the Article 32 investigation. The officer will read the charges, review evidence and call witnesses who will be questioned by prosecution and defense attorneys.

After the hearing, the investigating officer will submit a written report to the commander, which includes a determination of whether there are reasonable grounds to believe the defendant committed the charged offenses.

The defense has five days to submit objections or comments.

The commander then determines the next step, which could include continuing to a court martial or dismissing the charges.
