Army vet drops appeal in double murder

HOLLIDAYSBURG, PA. — An Iraq war veteran has ordered his attorney to drop an appeal seeking a new trial in the shooting deaths of a clerk and a bystander during the robbery of a central Pennsylvania sandwich shop.

Defense attorney Thomas Dickey told the Altoona Mirror that 33-year-old Nicholas Horner of Altoona no longer wants to challenge Blair County Judge Jolene Kopriva’s refusal to let him present an insanity defense.

Horner has been diagnosed with post-traumatic stress disorder from his Army service, but the judge wouldn’t let a jury consider an insanity defense before they convicted Horner of murder for shooting the clerk, 19-year-old Scott Garlick, and 64-year-old Raymond Williams during a robbery of the Altoona Subway shop on April 6, 2009.

Dickey said Horner didn’t want to put the victims’ families through another trial.
