RALEIGH, N.C. — A North Carolina appeals court has upheld a murder conviction in the death of a Fort Bragg soldier shot outside a nightclub while celebrating his safe return after more than a year in Iraq.
A three-judge panel of the state Court of Appeals on Tuesday said it found no errors in the 2012 Cumberland County trial of James Anthony Carr. Carr is serving a long prison sentence for second-degree murder for the death of Sgt. Sergio Sanchez of Alabama in 2008 and other crimes.
The court said Sanchez was the designated driver for some friends when a group who had robbed other soldiers approached Sanchez. Evidence shows a man demanded Sanchez’s wallet. Sanchez was shot in the neck and later died.
Carr’s projected prison release date is in 2035.
