Guidelines issued for special pay for medical evacuees

The Army has issued guidelines for administering a federal law that continues special pay and allowances for soldiers who are medically evacuated from a combat zone.

Under the provisions of Title 37 of the U. S. Code (Section 372), the Army will provide financial assistance to soldiers with combat-related injuries or illnesses by continuing certain pay and allowances that otherwise would be discontinued when they are evacuated from a combat zone because adequate medical care is not available in theater.

The special pays and incentives subject to the Pay and Allowances Continuation Program, or PAC, include hardship duty pay, hostile fire pay, hazardous duty pay, special duty assignment pay and assignment incentive pay.

Pay and allowances continued under PAC are non-taxable if the soldier is an inpatient, and taxable if an outpatient.

PAC does not include basic pay, basic allowance for housing, basic allowance for subsistence, clothing allowance, per diem and family separation allowance.

By law these pays are continued until a soldier returns to duty, or for 12 months, whichever occurs first, and in special cases can be extended beyond 12 months by the secretary of defense.

Major eligibility criteria for PAC is as follows:

A soldier, while in line of duty, and not the result of willful misconduct or gross negligence, incurs a wound, injury or illness,

Incurred as a result of a combat operation, combat zone service, hostile fire zone service or exposure to a hostile fire event, regardless of location, and

Is medically evacuated to a military treatment facility, Veterans Affairs hospital, civilian hospital or other treatment facilities, such as a civilian hospital while assigned to a community-based Warrior Transition Unit.
