Reservist sues school district to regain job

NEWARK, N.J. — A Navy reservist has sued the Newark school district for allegedly failing to rehire him after he returned from active duty.

The Justice Department has joined the suit on behalf of Navy Reserve member George Lawton.

Lawton taught as a substitute in the Newark schools beginning in 1997 and was offered a full-time teaching position in 2005.

But he was called to active duty in August 2005. He returned two years later.

Lawton says he was asked to reapply as a substitute teacher but received no response.

A 1994 federal law requires that individuals who leave jobs to serve in the armed forces be re-employed in comparable positions when they return.

A Newark school district spokeswoman did not return a call for comment Tuesday.
