NORFOLK, Va. — A Navy officer says the rights of five Somali men charged with piracy were not violated after their capture in the seas off the African coast.
The Virginian-Pilot reports that Lt. j.g. Chad Hutchins testified Thursday in Norfolk, where a judge is hearing 13 pretrial motions. The defendants' attorneys are arguing the men's rights were violated under the Geneva Conventions.
The five are accused of piracy and other charges related to an April 1 attack on the USS Nicholas. Attorneys for the men argue their alleged actions did not rise to the legal definition of piracy.
A different judge in the case of another group of Somali defendants tossed out the piracy indictment. A piracy conviction carries a mandatory life sentence.
